Social Media and Defamation

Have you been part of a dispute and resorted to posting it on social media? You could be taken to task for defamation.

Defamation refers to instances where harm is caused to another person’s good name or reputation, such as insults or false accusations. Courts have made it clear that the publication of defamatory statements on social media can lead to a damages claim or even criminal charges (crimen iniuria). Not only may the publisher of the information be liable, but any person who further distributes the information through sharing or linking may also be liable.
